I. Payment
terms
The cost of goods ordered is
payable under the following terms :
The price of goods ordered
is payable in full to Mon Millésime, from the moment the online order
form has been completed, by one of the following methods :
-
By credit card (secure online payment or by providing details of the
account number, expiry date and card holder by telephone, fax or
post.)
- By cheque, payable to "Mon Millésime"
- By
bank transfer.
II. Conditions
of sale
These conditions apply to
the sale of products in the Mon Millésime shop, over the internet and
by telephone. These conditions are automatically made available to the
buyer on the home page of Mon Millésime's web site.
The buyer
should click on "Terms and Conditions" to check these before starting
the order process.
Proceeding with an order implies complete
and unreserved acceptance of these Terms and Conditions. All other
documents, such as prospectus and catalogues provided by the vendor are
for reference purposes only and are not legally binding.
Our offers apply to both
individual clients and professional
retailers.
a. Cork
failure
According to international
practice, we cannot exchange corked
bottles.
b. Old
Wines
All our wines are stored
under ideal conditions in our cellar and the boutique in Beaune.
However, we cannot guarantee the perfect state and quality of wines
over 10 years old.
1. The
quotation
In the case of
professional sales, a quotation is provisionally valid for a period of
30 days, starting from the date the document was created. This document
should be returned by the client via fax, correctly filled in with full
company details and with the words "read and approved" written above
the signature of the client. Acceptance of the order in this way
implies acceptance of our general terms and conditions of
sale.
2. Preparation
of your
order
All orders are subject to acceptance by us and we will
confirm such acceptance to you by on-line electronic means (the
"Confirmation"). We expressly reserve the right to refuse any order
made by a customer with whom we have an ongoing dispute, or from anyone
we suspect of making purchases on our site by fraudulent
means.
Your order will
be prepared once Mon Millésime has cashed your payment and once all
necessary information has been received in order to honour the
contract.
The information required is as follows :

Return of the signed quotation via fax as mentioned above

Precise invoicing address, name of contact and telephone
number
- Precise delivery address and telephone number of the
recipient. These addresses and telephone numbers should be verified and
kept up to date by the person who places the order.
- If
applicable, any additional items accompanying the order (e.g.
envelopes, cards, business cards…)
The order will not be prepared until all the above
information has been received, including the relevant addresses and
additional items. Mon Millésime will not be liable for late delivery
caused by missing information.
If all or part of the delivery address is incorrectly
given, obliging Mon Millésime to return the goods to its premises, the
client will bear the cost of return.
3.
Delivery
Mon Millésime will accept your order and will organise
delivery as soon as payment has been received.
Except in the case of
"force majeure", delivery will be made to the client's home or other
given delivery address, within France or overseas, between one and
three weeks from the date of receipt of order and
payment.
We take great
care that our wines travel in ideal conditions. However the
merchandise will be travelling at your cost and your risk. Thus we
advise you to verify the contents of the package at the point of
delivery and to check the following details:
- The
carrier's delivery documents.
- The entire contents of the
package delivered.
Should you be in any doubt regarding the contents of
the package you must advise Mon Millésime in writing by recorded
delivery at the following address: 54 rue du Faubourg Madeleine, 21200
Beaune, FRANCE, within 3 days of receiving the
package.
In the case of
breakage or damage during the preparation or delivery of the order, Mon
Millésime will take steps to deliver a replacement, or reimburse the
total amount of the order. Your account will be re-credited and the
account of Mon Millésime will be debited as a
result.
4. Pricing
Policy
Prices are given in Euros. Prices indicated in other
currencies are simply for guidance. Your account will be debited in
Euros.
Prices given in
product descriptions do not include transport
costs.
The price given
in the Mon Millésime order confirmation is the final price, including
all taxes and VAT, if relevant (19.6% for purchases within
France),
Mon Millésime
reserves the right to modify prices at any time. All goods are invoiced
according to the price indicated at the time of
purchase.
5.
Late payment
In the case of
professional sales, according to article L 441-16 of the Code de
Commerce, late payment penalties are applicable from the day
after the due date indicated on the invoice. These penalties are
calculated at one and a half times the current legal interest
rate.
6. Refunds
policy
In accordance with article
L.121-16 of the Code de la Consommation, the client has up to 7 working
days following delivery of the goods to exchange them for goods of the
equivalent value or request a refund. In this case you must notify us
of your wish to cancel in writing (by email, via our " Contact Us "
page, by fax or by post.) and you must return the goods to us at your
expense in their original wrapping, intact and accompanied by all
accessories and documentation which were part of the delivery.
7. Duration
of the validity of offers
Our
products are on sale until stocks run out. In the case of wine being
ordered that is no longer in stock, Mon Millésime may modify the order
with the agreement of the client, for example offering the following
vintage or an equivalent wine.
8. Rights
reserved
Mon Millésime retains
ownership of the merchandise until the day the sum due has been paid in
full, conforming to the terms of law n°80 336 of the 1st May 1980,
relating to owners' rights. However, risk in the products will pass to you upon delivery.
9. Security of personal
information
In order to provide a
service which responds to your needs, we need to have some of your
personal details (surname, first name, address).
Mon Millésime
may pass on to you offers from other companies or organisations,
or inform you by telephone, post or email of our own offers. If
you would rather not receive this information please advise us via
"contact us". In accordance with the French Information Systems and
Liberty Law of 6th January 1978, you have the right to access and
rectify the data recorded. You can also modify your information simply
by contacting us via email or telephone.
Banking
information
When you buy on line, your bank details are
neither stored nor visible on the internet. It is not possible to
intercept the information you send.
10. Governing Law &
Jurisdiction
Contractual
information is presented primarily in the French language and products
proposed conform to French legislation. If the case arises, it is up to
the foreign client to verify with local authorities regarding their
right to use the product he or she wishes to purchase ; Mon Millésime
will not be responsible if clients have not respected the laws of the
country where the product is due to be delivered.
11. Protection of
minors
In order to comply with
article L.3342-1 of the Public Health Code, forbidding the sale of
alcohol to minors under eighteen (18) years of age, the client must
confirm that he or she is at least 18 at the time of ordering and
opening an account with Mon Millésime by ticking the relevant box on
the order form.
